1. ELIGIBILITY: Each Participant must be a United States citizen, residing in the 50 United States and the District of Columbia or a Canadian citizen and must be 18 years of age or older before January 1, 2003, to enter. The contest is offered electronically via the Internet. Employees and the immediate families of employees of the participating websites, their affiliates, advertising and promotion agencies are ineligible. Contest is void in Puerto Rico and where prohibited. Check your local restrictions.
2. CONTEST PERIOD: The contest will begin Monday June 9, 2003 and will be four weeks in length. You are responsible for creating and maintaining your own team and staying within the rules given on the team creation/modification page. Any failure to adhere to these rules will void your entry. Each week on Monday and Tuesday you will be asked to vote for 2 drivers that you wish to see eliminated from the talent pool. The 5 drivers that receive the most votes are eliminated. You will receive an e-mail on Tuesday evenings during the contest period with these results. You will then have until Thursday at midnight to restructure your team as needed if one or more of your drivers was eliminated. Failure to do so will result in a "no-entry" for that week. The contest ends with the conclusion of the Pepsi 400 at Daytona on July 5, 2003. The overall winner will be announced on Monday July 7, 2003.
If you choose not to play the game, but file an Alternate Entry instead, you may answer the 5 questions and submit your entry at any time during the contest period.
3. HOW TO ENTER: The link to enter is at the bottom of this page and by clicking that link you agree to all the rules stated on this page. Incomplete entries may be rejected at the sole discretion of the contest administrator.
4. CONTEST PRIZE: Each week during the contest period the person who earns the highest score wins a FansMotorSports.com membership. Also, one entry is drawn from the Alternate entries and they too win a membership. A pair of Busch series tickets will be awarded to the person with the highest score after the 4 week contest period. Alternate entries are not eligible for the Busch tickets.Fansmotorsports.com will contact the winner with the info required to establish their free membership and to receive the Busch tickets. The prizes are being offered solely by FansMotorSports.com and any issues arising from acceptance, availability or qualtiy of these prizes should be addresses to FansMotorSports directly. Approximate value of all prizes is $600.
5A. SCORING: If you have created a valid team with 5 drivers and have stayed under or equal to the advertising budget given, your team will earn points as follows:
Your "race" drivers earn the same points that they are awarded during the real NASCAR race and your "qualifier" earns points based on his qualifying results as if points were awarded just like the finish of a race.(i.e. 175 1st, 170 2nd, etc.) Your qualifier does NOT earn points during the race.
5B. WINNER SELECTION AND NOTIFICATION: See (4. CONTEST PRIZE) above.
Tiebreakers:
At the end of each week, should two or more contestants be tied with identical scores, a random drawing will determine the weekly winner.
At the end of the contest, should two or more contestants be tied with identical scores, the following tie-breakers will be used in order until a winner can be determined. Once a winner is determined, subsequent tiebreakers will not be used:
On the registration page, there will be a place to answer the 2 tie-breaker questions. You must answer them when you register your team and you can not go back and change them once they are entered.
Tie Breaker #1) Who will win the Pepsi 400 at Daytona on July 5th 2003??
Tie Breaker #2) What will the Pole speed be in MPH? Closest without going over. Speed to be given to 2 decimal places. Example, 198.21 MPH
The Winner will be notified no later than Monday July 9, 2003 via e-mail and their name will be posted on the site as the winner.
6. TERMS: By participating, contest entrants agree to abide by the terms of these Official Rules and by the decisions of the Contest Administrator, which are final on all matters pertaining to the Contest. The Contest Administrator reserves the right, in his sole discretion, to adjust the dates or cancel this promotion for any reason including, technical failure and/or unauthorized intervention. The Contest Administrator and all websites participating in this contest, their parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Contest Administrator, that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest or (vi) any printing or typographical errors in any materials associated with the Contest. The Contest Administrator reserves the right, in his sole discretion, to change these Official Rules, upon proper legal notice if required by law. NASCAR and NASCAR.com are not affiliated with this Contest. By participating, participants agree to indemnify, defend and hold harmless the Contest Administrator and all participating websites and their respective parent and affiliate companies from and against any loss or damage arising out of participant's participation in the contest.
7. Contest Administrator: This contest is being run and managed by InsideThePitBox.com and InsideThePitBox.com only. The participating and advertising websites have no control or effect on any aspect or outcome of this contest and are not be held liable in any way. Any legal issues, concerns, or questions arising from this contest should be directed to Contest@insidethepitbox.com.
8. TAX LIABILITY: The reporting and payment of any tax liabilities incurred by any winner(s) as a result of this Contest are the sole responsibility of the winner(s).
9. GENERAL RELEASE: By entering the Contest, participant agrees to release and hold harmless the Contest Administrator, the participating websites and their parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waives any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Participant further agrees that all rights under any state or territory of the United States are hereby expressly waived.
10. CONDUCT: The Contest Administrator reserves the right at his sole discretion to disqualify any individual he finds to be tampering with the operation of the Contest or web site or, to be acting in violation of the Official Rules. Any person found tampering with or abusing any aspect of this game, as solely determined by the Contest Administrator, will be disqualified. If disqualified for any of the above abuses, the Contest Administrator. reserves right to terminate entrant's eligibility to participate in game.
11. WINNERS LIST: The winner will be listed at http://www.insidethepitbox.com/fsr/index1.asp for a period of less than 60 days following the conclusion of the contest.
